1. Introduction
Welcome to CentralCommonsAtrium ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at centralcommonsatrium.sbs (the "Service") managed by CentralCommonsAtrium.
When you book a charter or use our Service, you consent to these Terms. If you do not agree with any part of these terms, you should not use the Service.
2. Service Overview
CentralCommonsAtrium offers various yacht charter services, including but not limited to:
- Yacht rentals for the day
- Evening sailings
- Business gatherings
- Personal celebrations
- Extended yacht charters
We may change or stop services according to availability and weather conditions, at our sole discretion.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you are required to:
- Have a minimum age of 18 years
- Supply valid and complete details
- Remit the necessary deposit as outlined in the reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your reservation occurs only after payment is received and we issue written confirmation. We retain the right to deny service to anyone at our discretion.
3.3 Availability
All charters depend upon availability of the vessel and acceptable weather conditions. We will strive to accommodate your requested dates and timing.
4. Payment Terms
4.1 Pricing
Prices are quoted in € and include taxes unless stated otherwise. Prices may change without prior notification.
4.2 Payment Schedule
- Deposit: Required payment of 50% of the total cost at the time of reservation
- Final Payment: Payable 48 hours before the departure of the charter
- Incidental expenses (if any): Payable following the end of the charter
4.3 Payment Methods
Accepted methods of payment include major credit cards, transfers via banks, and certified checks. Payments are processed using secure encryption systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Complete refund minus service charges
- 24-72 hours before departure: Refund of 50%
- Less than 24 hours before departure: No refund is available
5.2 Weather Cancellations
Should the weather be unsafe as determined by the captain, we will propose to:
- Rebook the charter for another date at no further cost
- Issue a full refund if rescheduling is impracticable
5.3 Mechanical Issues
If there is a mechanical malfunction with your designated vessel, we will try to offer an appropriate alternative. Should no substitute be available, we will provide a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
Passengers must:
- Obey all instructions from the crew
- Utilize the safety equipment provided when necessary
- Disclose any health conditions that could impact their safety
- Stay within the safe areas on the yacht at all times
6.2 Prohibited Items
Items not allowed onboard include:
- Containers made of glass
- Illegal substances
- Weapons of any kind
- Non-alcoholic beverages in excess quantities
- Pets (without prior approval)
6.3 Conduct
We expect passengers to behave respectfully. We may terminate a charter ahead of schedule without a refund if the conduct of any passenger compromises safety or disturbs other guests.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the cost paid for the charter. We are not accountable for:
- Injuries due to passenger carelessness
- Theft or destruction of personal belongings
- Indirect, incidental, or punitive losses
- Delays caused by inclement weather or unforeseen events outside of our control
7.2 Insurance Coverage
Our operations and vessels are covered by comprehensive marine insurance. Travel and personal insurance coverage is the responsibility of each passenger.
7.3 Assumption of Risk
By engaging in our charter services, you recognize that maritime activities carry inherent dangers and you accept responsibility for your personal safety and security.
8. Modifications and Itinerary Changes
We may alter itineraries, paths, or schedules due to weather conditions, safety necessities, or strategic considerations. We will endeavor to arrange equivalent alternate experiences.
9. Force Majeure
We are not accountable for postponements, cancellations, or changes caused by forces beyond our control, which may include:
- Severe weather
- Natural catastrophes
- Regulatory impositions
- Closure of ports
- Technical failures
10. Privacy and Data Protection
We manage your personal data in compliance with our privacy policy. By accessing our services, you agree to the collection and use of your data as outlined in the Privacy Policy.
11. Intellectual Property
Content on our site, such as text, imagery, and logos, is guarded by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our explicit consent.
12. Governing Law
The laws that apply in Germany govern these Terms. We will address disputes in the courts geographically situated in Hamburg, Germany.
